Terms of Use

The rules of the road for using stash.trade.

These Terms of Use ("Terms") form a binding agreement between you and the operator of stash.trade(the "Service", "we", "us"), accessible at d4.affix.trade and related domains. By creating an account, signing in or otherwise using the Service you confirm that you have read, understood and accepted these Terms. If you do not agree, do not use the Service.

01Who we are and what stash.trade is

stash.trade is a community-driven listing platform that lets players publish offers to trade Diablo® IV items and services in-game. The Service is fan-made and is not developed by, affiliated with, endorsed by or sponsored by Blizzard Entertainment, Inc. or any of its affiliates. Diablo®, Battle.net® and all related names, marks and assets are the property of their respective owners.

stash.trade is a listing and coordination tool only. We do not process payments, do not act as an escrow, do not take ownership of listed items and are not a party to any trade.

02Eligibility

You must be at least 13 years old to use stash.trade. By using the Service you represent that you meet this minimum age and that you have legal capacity to enter into these Terms in your jurisdiction. If you are between 13 and the age of majority where you live, you must use the Service with the knowledge of a parent or legal guardian.

You are also responsible for complying with the End User License Agreement and rules of Diablo® IV and Battle.net® published by Blizzard. We do not grant any rights related to the game itself.

03Accounts

Accounts are created through third-party identity providers (currently Battle.net and Discord). Additional providers may be added or removed in the future without further notice. You are responsible for keeping your provider credentials secure and for any activity that occurs under your account. Notify us immediately through the contact form if you suspect unauthorised access.

You may close your account at any time. We may suspend or terminate accounts in accordance with Section 9.

04Listings, services and trades

  • Listings and service offers must accurately describe the item or service, including rarity, stats, item power, class restrictions and any caveats.
  • All trades happen directly between players in the Diablo® IV game using in-game gold and game-supported trading mechanics. Real-money trades, fiat payments, cryptocurrency, gift cards and any payment outside the game are strictly forbidden on the Service.
  • Items obtained through cheating, exploits, duplication bugs, third-party automation, account-sharing-for-hire or other violations of Blizzard's rules must not be listed.
  • Power-leveling, boss-carry and similar services must be performed by you personally; account-sharing services that require handing over your Battle.net credentials are not allowed.
  • We may remove, hide or de-rank listings that violate these Terms, our community guidelines or applicable law, with or without notice.

05Acceptable use

You agree not to:

  • Harass, threaten, defame, dox, scam or otherwise harm other users.
  • Post unlawful, hateful, sexual, violent or otherwise inappropriate content.
  • Impersonate other users, Blizzard staff or stash.trade staff.
  • Attempt to disrupt the Service, bypass security, exploit vulnerabilities or scrape large volumes of data without prior written permission.
  • Use bots, headless browsers or other automated means to interact with the Service, except for officially documented APIs (if any).
  • Use the Service to solicit or facilitate real-money trades, gambling, money laundering or any illegal activity.
  • Upload malware or content infringing third-party intellectual-property rights.
  • Operate multiple accounts to circumvent moderation actions.

06Content you submit

You retain ownership of the content you submit (listings, service offers, messages, screenshots, ticket attachments). By submitting content you grant stash.trade a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, transmit and process that content for the sole purpose of operating, securing and improving the Service. This licence ends when you delete the content or your account, except for copies retained for backup, legal compliance or moderation evidence as described in the Privacy Policy.

You confirm that you have the right to submit the content you upload and that it does not infringe anyone's rights. Item screenshots used by our OCR feature are processed as described in the Privacy Policy.

07Reports, moderation and notice-and-action

In line with Article 16 of the EU Digital Services Act (Regulation 2022/2065) we provide a notice-and-action mechanism. If you consider that a specific listing, service, message, conversation or user violates these Terms or applicable law, you can submit a report directly from the relevant page using the "Report" button, or through our contact form. A valid report should include:

  • A precise description of the alleged illegality or rule violation.
  • Sufficient information to locate the content (URL, listing ID, message ID, user handle).
  • A statement that the report is submitted in good faith.
  • Your contact details (unless reporting anonymously is appropriate, e.g. for safety reasons).

We review reports without undue delay. Where we decide to remove content, restrict visibility, suspend or terminate an account, we provide the affected user with a statement of reasons (DSA Article 17) and information about how to contest the decision. Repeated submission of manifestly unfounded reports may itself be a Terms violation.

08Internal complaint handling and out-of-court dispute settlement

If you disagree with a moderation decision affecting your account or your content, you can submit a complaint within 6 months through the contact form. We aim to handle complaints fairly, without undue delay and free of charge, and a human will review every complaint.

EU users also have the right to bring disputes about moderation decisions before a certified out-of-court dispute settlement body under DSA Article 21, and to use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) where available. This does not affect your right to seek a remedy in a court of competent jurisdiction.

09Suspension and termination

We may suspend or terminate your access to all or part of the Service — with or without notice — if you breach these Terms, applicable law, or if we reasonably believe your continued use poses a risk to other users, the Service or third parties. Where the law permits, we will provide a statement of reasons and information about how to appeal.

You may stop using the Service and delete your account at any time. Some provisions of these Terms (such as Sections 6, 10, 11 and 14) survive termination.

10Disclaimer of warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of listings, availability or absence of bugs. Trades happen between players outside the Service and we do not guarantee the outcome of any trade.

11Limitation of liability

To the fullest extent permitted by applicable law, stash.trade and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, lost profits, loss of in-game goods, gold or items, loss of data or loss of goodwill arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited by law (in particular, liability for intentional misconduct or gross negligence and consumer-protection rights you cannot waive under EU law).

12Indemnity

You agree to indemnify and hold harmless the operator of stash.trade against third-party claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service or content you submit.

13Changes to the Service and to these Terms

We may modify, suspend or discontinue parts of the Service at any time. We may update these Terms when we add features, address legal changes or improve clarity. The "Last updated" date at the top of this page reflects the latest revision. For material changes we will display a notice in the application before the change takes effect; continued use after the effective date constitutes acceptance of the updated Terms.

14Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland, without prejudice to mandatory consumer-protection rules of the country where you habitually reside in the European Union. Any dispute that cannot be resolved through our internal complaint procedure or out-of-court dispute settlement shall be brought before the courts having jurisdiction at the seat of the operator. EU consumers may always bring proceedings before the courts of their country of residence.
